These terms apply to mesopic.ca and every Mesopic product, including Compass. Please read them before you buy anything.
Mesopic ("Mesopic", "we", "us") is a software studio based in Ottawa, Ontario, Canada. These Terms of Service ("Terms") govern your use of mesopic.ca, its subdomains (such as compass.mesopic.ca, pulse.mesopic.ca and guesser.mesopic.ca), and any other Mesopic product, app or website that links to these Terms (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
Consulting and software development work we do for clients is governed by a separate written agreement with that client, not by these Terms.
Some of our products are free to use. Others may be offered for a one-time fee or another price shown before you buy. Demo and free products are provided as they are, and we may change or retire any product at any time.
You must be old enough to form a binding contract where you live (or have a parent or guardian's permission) to make a purchase. Some products have a higher minimum age, listed in the product-specific terms below.
Our Refund Policy explains when and how you can get a refund. It forms part of these Terms.
Some products come with extra terms, listed below. They apply in addition to the rest of these Terms. If a product-specific term conflicts with the general terms, the product-specific term applies to that product.
Compass is a self-reflection tool. It is not a scientifically validated, clinical, psychological, psychiatric, medical or diagnostic assessment, and its results may not be accurate for you.
Compass reports are generated automatically, using fixed rules, from your own answers. They describe how you see yourself at the time you take the test and can change with mood, context and time. A report is not professional advice of any kind.
You agree not to misuse the Services. In particular, you will not: attempt to get paid content without paying for it; interfere with, overload or try to gain unauthorized access to the Services or their infrastructure; scrape, copy or resell our content or reports at scale; or use the Services for anything unlawful, harmful or deceptive.
The Services, including their design, text, content and code, belong to Mesopic or its licensors. When you buy a digital product, such as a Compass report, you may keep, print and share your own copy for personal, non-commercial purposes. You may not republish or resell our content or use it to build a competing product.
Some content comes from public-domain sources (for example, some Compass assessment items come from the International Personality Item Pool). That content remains in the public domain.
The Services rely on third-party providers (for example hosting, fonts, maps and payment processing) and may link to other websites. We are not responsible for third-party services or websites, and your use of them is subject to their own terms.
To the fullest extent permitted by law, the Services and all reports are provided "as is" and "as available", for informational and entertainment purposes, without warranties of any kind, whether express or implied, including any warranty of accuracy, reliability, availability or fitness for a particular purpose. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, Mesopic will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, opportunity or goodwill, arising from your use of, or inability to use, the Services or any report, or from any decision you make based on a report. Our total liability for any claim relating to the Services is limited to the amount you paid us for the product the claim relates to in the 12 months before the claim arose.
Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.
We may update these Terms from time to time. The "Effective" date at the top shows when they last changed. Changes apply from that date and do not affect purchases you made before it.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory laws of the place where you live.
